Abstract/Sommario: In every country, business men and manufacturers are inclined to entrust the settlement of their differences and disputes to arbitrators chosen by them in order to bring about a rapid decision at a minimum expense. They resort to this method, whether they are dealing at home or abroad.
Through its Court of Arbitration the International Chamber of Commerce provides business circles with facilities for the settlement of disputes arising out of transactions with foreign countries. They resort to this method, whether they are dealing at home or abroad.
Through its Court of Arbitration the International Chamber of Commerce provides business circles with facilities for the settlement of disputes arising out of transactions with foreign countries. The experiencc which the International Chamber has acquired since its inception more than 40 years ago has shown that an international uniform legislation aimed at simplifying recourse to arbitration would greatly contribute to a wide-spread use of the arbitration procedure. As long as the laws governing arbitration will vary from one country to another, there will be uncertainty as to the validity of arbitration clauses and the eventual carrying out of arbitration awards in a foreign country. That is why the International Chamber of Commerce, whilst continually advocating the international unification of law, has published a series of pamphlets describing the legal regulations in the field of arbitration in various countries.
The present pamphlet has been prepared at the request of the Conference on International Commercial Arbitration, which was held from 13th to 15th June, 1946, at the Headquarters of the International Chamber of Commerce in Paris.
It gives a table of the principal regulations governing arbitration agreement, arbitrators, arbitration procedure, award, its enforcement and means of recourse against the award in 66 countries. The various summaries have been carefully checked by experts of the countries concerned.
The International Chamber of Commerce hopes that this publication will prove a practical guide to all interested in International commercial arbitration, as long as this procedure is not subject to a uniform regulation.
The International Chamber of Commerce is glad to take this opportunity to express its gratitude to all those who have assisted it with their advice and cooperation in the drafting of this brochure.
